Court Orders EFCC to de-freeze Fayose Accounts

A federal high court sitting in Ado Ekiti has ordered the EFCC to defreeze the two accounts of Ekiti state governor, Mr Ayo Fayose saying the anti-graft agency did not follow the due process in carrying out the action.
The court said the anti-graft agency did not follow due process.

Justice Taiwo Taiwo who gave the order while delivering a judgment which lasted more than two hours in a suit filed by the governor, through his counsel, Chief Mike Ozekhome said the rights of the governor had been unconstitutionally infringed upon, considering the circumstance of his office .

He declared that apart from the immunity which Fayose  currently enjoy as a sitting governor under section 308 of the constitution, it was wrong for the EFCC to have gone ahead to seize his two accounts in apparent perpetuity without first investigating him or making him a party.

He averred that rather than the EFCC freezing the governor's accounts directly through the third party who did not enjoy any mandate from him to , the governor himself ought to have been first investigated and brought into the picture.

He described Fayose as “a genuinely deprived person who rushed to the court to seek constitutional protection”

He said it was also the duty of any presiding judge to protect the said constitution and its interpretations whenever the need arises.

“The Plaintiff is entitled to be heard before his property or money can be seized, doing otherwise will amount to denying him fair hearing and constitutional rights”, the judge added.

The judge however refused to grant other reliefs sought by the governor, including a perpetual injunction restraining EFCC or its agents from further tampering with his property, and another one asking for payment of N5billion as exemplary damages.

“This court will not shield any person from due investigation. Since Police cannot be stopped from investigating a crime, same goes for the First Respondent so as not to whittle down its functions", the judge said.

The governor's accounts with the Ado Ekiti branch of the Zenith Bank Plc were frozen on June 21,2016 saying the money found in the two accounts was suspected to be proceeds of crime, but the governor took the agency and the bank to court on June 26, 2016.

The governor promised to accord top priority to education, as well as providing an enabling environment for Quranic schools to thrive. ”We will soon conduct a census of these schools to ascertain their number and know how to improve them,” he added. The Chairman of the occasion, Prof. Sambo Junaidu, said the event was organised to commemorate the birth of the Holy Prophet Muhammad, Peace Be Upon Him. Junaidu also said it was  to reflect on the prophet’s virtuous life, with a view to emulating his sterling qualities of humility, piety and generosity, among others. No ‘special centres’ for WAEC exams- Registrar

Registrar, West African Examinations Council (WAEC), Dr Iyi Uwadiae, has said that there are no “miracle’’ or “special’’ centres used anywhere for the council’s examination as speculated by some members of the public.Uwadiae made the assertion at a News Agency of Nigeria (NAN) forum in Lagos.According to him, rather thansay there are miracle or special centres, it is convenient to say that there are examination malpractice prone centres.He noted that such centres where students indulge in collation, exchange ideas and help each other was what led to candidates in a particular centre performing exceptionally than expected.The registrar said that such adevelopment, when they go unreported and students perform high was what the public term as being a miracle centre.“Agreed, we will not dispute the fact that some locations are prone to examination malpractices.“Take the riverine areas for instance; we all know that it is difficult to access such places.“An examiner or supervisor manages to get there with question papers with need tobe there with the inspectors from the Ministry of Education, from WAEC and some other stakeholders.“What happens in a situation where there is only one boat or canoe that plies the area and must have gone with only the supervisor early in the morning to return at about 12 mid-day?“Certainly by that time the examination would have been over, meaning that the examination was conducted with only the supervisor and the local invigilators from that area.“In such cases, there are chances that malpractice must thrive in such centres,’’ he said.Uwadiae said that in the course of the examination, the life of the supervisor could be under threat as he alone would not be able to challenge the action of the candidates.“Because of this, we normallytell the supervisors that when they are faced with such difficult situation, they should please cooperate.“They are told not to write anything they experienced right there at the centre, whatever they notice, they should try and memorise.“When these supervisors are out of that place, hale and hearty, then they can now filetheir situation report and thatis why often times we have many centres that are de-recognised,’’ he said.He added that it was such developments that normally led to the cancellation of entire results of some centres.The registrar said the councilrecognised the fact that therewere examination malpractice-prone centres which the public might have termed as special centres but that in the actual sense they are not.He added that the council members were not miracle workers to be everywhere and that was why many otherstakeholders were co-opted in the conduct of the examinations.Uwadiae said if a centre was prone to examination malpractice and no report was made concerning activities in such centres by the supervisors, there was noway the council would know and act on it.He said such also applied to the script markers who would mark and discover a case of possible collusion among candidates and wouldnot report.“We will not know what has transpired and so, when they finish such marking, the scripts are put together and returned to the rooms where they are kept.“We will not know what transpired as they only submit the marks and the attendance sheets where the marks are recorded before we now scan them into the computers“If we should have any suspicious development about the performance of anyscript, we do not hesitate to call for such a script and get an independent examiner who will go through and perhaps discover or confirm our fears.“When this is done, we now can establish a case against the school and subsequently cancel the entire result,’’ he said.The registrar added that WAEC did not work based on assumption, noting that it always ensured that there were evidence to hold on to before taking action against any candidate or school as the case may be.Uwadiae said where there were no such evidence or exhibits, the candidates wereusually let off the hook as punishing them based on assumption could lead to legal action against the council.According to him, it will be wise for employers of labour to always ensure that aptitude tests are conducted to ascertain the authenticity of results provided by job seekers side by side their performance in examinations.“We have told employers of labour that if by any chance they have cause to doubt the kind of result presented by a job seeker that does not reflect his or her performance in the test, they should come to us.“If the scripts of such a person has not been destroyed, we can do a remark and thereby assist in providing an evidence upon which we can establish the fact that there could have been a form of malpractice,’’ he said. 22 ROASTED TO DEATH IN EDO AUTO CRASH..

NO fewer than 22 persons were burnt to death in a multiple motor accident which occurred at Abudu along the Benin-Asaba dual carriage way yesterday, while five persons sustained various degrees of injuries.

Edo sector of Federal Road Safety Corps (FRSC), Public Relations Officer, Mr. George Otoaviokhai who confirmed the accident listed vehicles involved to include two buses, one Sienna, one Dyna truck, one tanker, one Ford bus, one Toyota Corolla and one motor cycle.

He disclosed that everyone in the two buses, Sienna and Corolla were burnt to ashes attributing the cause of the accident to brake failure.
Otoaviokhai said, “the bullion van actually broke down and they were trying to fix it. They diverted the traffic and it was in the process of diverting the traffic that a tanker loaded with fuel rammed into other vehicles.

Officials of the fire service were invited to put out the fire and pull the vehicles involved out of road.

Election: Results of some seats ready, says INEC

Port Harcourt – Dr Mustapha Lecky,
 National Commissioner of the Independent National Electoral Commissioner (INEC) for the South-South Zone, says results of some seats in Rivers re-run legislative elections are ready. Lecky, who did not give details of the results, told OrisfinaNEWS Reporters in Port Harcourt on Sunday that one of the three senatorial districts, two of the eight House of Representatives and five of the 10 state assembly seats were ready. He said that the commission was awaiting the remaining results in other constituencies. “ We have made some progress in collating the results of this election and I can confirm that a number of the results have been declared. “ In two of the eight House of Representatives, we have made some declarations, five of the ten state assembly seats have been declared and one of the three senatorial districts have been declared,” he said. Lecky said the results were declared by the returning officers at the constituency levels. Stampede in Synagogue Church of all Nations reportedly kills three worshippers

Three worshipers were purportedly feared dead at the Synagogue Church of all Nations, SCOAN, Ikotun, Lagos, Weekend, after a stampede on the church’s premises. It was gathered that the victims were part of a crowd that struggled to see the church’s General Overseer, Prophet Temitope Joshua, during a Prophetic Service.
